Loan Oigination Date before 01/01/2009

If the loans (first and second mortgages) were originated on 12/02/2008(application taken and signed by loan officer)but the loan with BofA has a date of 01/02/2009 due to signing documents at the Title Co in December 08 but holidays delay - is the loan eligible for a modification?

The loan origination date is the date of the Promissory Note, regardless of when the loan application was initially signe.

Please check your paperwork and find your note to see if your loan closed and originated prior to Jan 1, 2009.
